These Terms of Service ("Terms") are a legal agreement between you and Spotter Coach ("we", "us", or "our"), operated by Matti, based in Hungary. By downloading, installing, or using the Spotter Coach mobile application ("the App"), you agree to these Terms in full.
If you do not agree with any part of these Terms, do not use the App.
1. Eligibility
You must be at least 16 years old to use Spotter Coach. If you are between 16 and 18, you must have permission from a parent or legal guardian, and they must agree to these Terms on your behalf.
By using Spotter Coach, you confirm that you are at least 16 years old, have the legal capacity to enter into this agreement, and are not prohibited from using the App under the laws of your country.
We reserve the right to terminate accounts where we discover the user does not meet these requirements.
2. Your Account
To use Spotter Coach, you need to create an account. You are responsible for keeping your login credentials secure, all activity that occurs under your account, and ensuring your account information is accurate.
You may not share your account with others or create accounts on behalf of someone else without their consent. If you suspect unauthorised access, contact us immediately at [email protected].
3. What Spotter Is — and Is Not
Spotter is a fitness logging and social accountability app designed to help you track workouts, log food, and stay motivated with friends.
Spotter is NOT a medical device, a substitute for professional medical or nutritional advice, or a certified personal trainer or dietitian.
Any fitness or nutrition information within the app — including data from the Spot AI assistant — is provided for general informational purposes only. Always consult a qualified professional before starting a new workout programme or making significant dietary changes, especially if you have a medical condition or injury.
We are not responsible for any injury, health issue, or harm that results from following information or suggestions within the app.
4. Health Data and Consent
Spotter Coach collects and processes special category health data as defined under GDPR Article 9, including body weight, food logs, fitness goals, and any health notes you voluntarily provide. By completing onboarding and providing explicit consent, you agree to the processing of this data solely for the purpose of providing personalised fitness coaching. You may withdraw consent at any time by deleting your account.
5. Spot — AI Assistant
Spot is powered by Google Gemini. Spotter Coach includes Spot, an AI-powered fitness assistant. You have the right to request human review of any AI-generated recommendation under GDPR Article 22. When using Spot:
- Responses are AI-generated and may not always be accurate
- Do not rely on Spot for medical, clinical, or emergency advice
- Do not share sensitive personal information (passwords, financial details, medical diagnoses) in Spot conversations
- Your conversations with Spot are stored and used to provide the service
- Spot makes personalised suggestions based on your health data — these are informational only and do not constitute medical advice
- Spot's suggestions are based on your workout history, nutrition data, and stated goals — the logic is not hidden from you
We are not liable for any decisions you make based on Spot's responses.
6. Things Spot Should Know
You may optionally provide Spot with personal health context such as injuries, dietary restrictions, and training preferences via the "Things Spot Should Know" feature in Settings. This information is used solely to personalise Spot's coaching. You can view, edit, or delete this information at any time. Providing this information is entirely voluntary.
7. Acceptable Use
You agree to use Spotter Coach only for lawful purposes and in a way that does not infringe the rights of others. You must not post abusive, hateful, or threatening content, upload sexually explicit or violent content, impersonate any person, spam or advertise to other users, attempt unauthorised access to our systems, reverse engineer the App, use automated bots or scrapers, upload content that violates intellectual property rights, or use Spot to generate harmful or illegal content.
We reserve the right to remove any content and suspend or terminate any account that violates these rules.
8. Your Content
8.1 Ownership
You own the content you create and upload to Spotter Coach — your workout logs, food entries, progress photos, and posts.
8.2 Licence to Us
By posting content on Spotter Coach, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content solely for the purpose of operating the Spotter Coach service. This licence ends when you delete the content or your account.
8.3 Content You Share
You are solely responsible for the content you post. By sharing content you confirm you have the right to share it, it does not violate anyone else's rights, and it complies with these Terms.
8.4 Content Removal
We may remove content that violates these Terms without notice.
9. Subscriptions and Payments
9.1 Free Tier
Core features of Spotter Coach are free and will remain free.
9.2 Spotter Pro
Spotter Pro is an optional paid subscription. Subscriptions are processed through Apple App Store or Google Play Store. By subscribing, you also agree to those platforms' terms and billing policies.
9.3 Billing
Your subscription renews automatically unless you cancel before the renewal date. You can manage and cancel your subscription through your App Store or Google Play account settings.
9.4 Refunds
Refund requests are handled by Apple or Google in accordance with their respective policies.
9.5 Price Changes
We may change subscription prices with at least 30 days' notice. Continued use of Spotter Pro after the effective date constitutes acceptance of the new price.
10. Intellectual Property
All content, design, code, branding, and features of Spotter Coach — excluding your user content — are owned by us or our licensors. You may not copy, reproduce, distribute, or create derivative works from any part of Spotter Coach without our written permission. "Spotter Coach" is our registered application name. The in-app branding "Spotter" is used for user experience purposes only and does not constitute a trademark claim on that term.
11. Third-Party Services
Spotter Coach integrates with:
- Supabase — backend infrastructure
- Google (Gemini API) — powers the Spot AI assistant (Data Processing Agreement in place)
- RevenueCat — subscription management
- Open Food Facts — food barcode database
- Apple App Store and Google Play — distribution and billing
- PostHog — analytics
Your use of these services is subject to their own terms and privacy policies.
12. Disclaimers
To the fullest extent permitted by applicable law, Spotter Coach is provided "as is" without warranties of any kind. We do not warrant that the App will be uninterrupted or error-free, and we do not guarantee the accuracy of any fitness, nutritional, or AI-generated content.
Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, as required by Hungarian and EU law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for indirect, incidental, or consequential damages, loss of data or content, personal injury resulting from reliance on app content, or any damages exceeding the amount you paid us in the 12 months preceding the claim (or €20 if you have not paid anything).
14. Termination
14.1 By You
You may delete your account at any time through app settings. Deleting your account removes your personal data in accordance with our Privacy Policy.
14.2 By Us
We may suspend or terminate your account if you violate these Terms or engage in behaviour that harms other users. We will give reasonable notice where possible, except in cases of serious or repeat violations.
14.3 Effect of Termination
Upon termination, your right to use Spotter Coach ends immediately. Sections covering intellectual property, disclaimers, and limitation of liability survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of Hungary and, where applicable, EU law — including the EU Consumer Rights Directive and GDPR.
If you have a dispute, contact us first at [email protected] and we will attempt to resolve it informally within 30 days. If unresolved, disputes may be submitted to the competent courts of Hungary.
If Spotter Coach reincorporates outside Hungary, we will update these Terms and notify all users at least 30 days in advance.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app and update the date at the top. Continued use after changes take effect constitutes acceptance of the updated Terms.
